(the “Service”), operated by Dave Van Cauwenberghe (“we”, “us”, “our”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

The Service provides personal cloud storage, file synchronization, sharing, and collaboration features using the Nextcloud platform.

The Service is provided on a best‑effort basis and is primarily intended for personal and limited collaborative use.

2. Eligibility

You must be at least 16 years old (or the minimum legal age in your country) to use the Service.

By using the Service, you confirm that you meet this requirement.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your login credentials

• All activities that occur under your account

• Keeping your contact information accurate

You must immediately notify us if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use the Service to:

• Upload or distribute illegal content

• Violate copyright or intellectual property rights

• Distribute malware, viruses, or harmful code

• Attempt to gain unauthorized access to systems or data

• Abuse, harass, or harm others

• Use the Service for large‑scale commercial hosting without permission

7. Backups and Data Loss

While reasonable measures are taken to protect data, no system is 100% secure.

You are responsible for maintaining your own backups of important data.

We are not liable for data loss caused by:

• Hardware failure

• Software bugs

• Security incidents

• Force majeure events

8. Availability

The Service is provided “as is” and “as available”.

We do not guarantee:

• Continuous availability

• Error‑free operation

• Specific performance levels

9. Termination

You may stop using the Service at any time.

Deze Algemene Voorwaarden (“Voorwaarden”) zijn van toepassing op het gebruik van de Nextcloud‑dienst gehost op cloud.davevancauwenberghe.be (de “Dienst”). Door gebruik te maken van de Dienst gaat u akkoord met deze Voorwaarden.

1. Definitie van de Dienst

De Dienst biedt gebruikers persoonlijke cloudopslag, bestandsdeling, synchronisatie en gerelateerde functionaliteiten via de Nextcloud‑software.

De Dienst wordt aangeboden op basis van “best effort” en zonder garanties op permanente beschikbaarheid.

2. Toegang en accounts

• U bent verantwoordelijk voor alle activiteiten die plaatsvinden onder uw account.

• U dient uw inloggegevens vertrouwelijk te behandelen.

• U mag geen toegang proberen te verkrijgen tot accounts of gegevens van andere gebruikers.

De beheerder behoudt zich het recht voor om accounts te beperken, op te schorten of te verwijderen bij misbruik of overtreding van deze Voorwaarden.

3. Toegestaan gebruik

U stemt ermee in de Dienst niet te gebruiken voor:

• Illegale activiteiten

• Het verspreiden van malware, virussen of andere schadelijke software

• Ongeautoriseerde toegang tot systemen of netwerken

• Schending van auteursrechten of andere intellectuele eigendomsrechten

• Het hosten of verspreiden van illegale inhoud

4. Opslag en gegevens

• U blijft eigenaar van uw gegevens.

• De beheerder heeft geen interesse in de inhoud van uw bestanden, behalve waar technisch noodzakelijk voor beheer en onderhoud.

• Back‑ups worden mogelijk uitgevoerd, maar vormen geen garantie tegen dataverlies.

U bent zelf verantwoordelijk voor het bewaren van aanvullende back‑ups van belangrijke gegevens.

5. Beschikbaarheid en onderhoud

De Dienst kan tijdelijk onbeschikbaar zijn wegens onderhoud, updates of technische problemen.

Er wordt geen garantie gegeven op:

• Continue beschikbaarheid

• Ononderbroken toegang

• Foutloze werking

6. Beveiliging

Redelijke technische en organisatorische maatregelen worden genomen om gegevens te beschermen. Absolute beveiliging kan echter niet worden gegarandeerd.

Gebruik van de Dienst geschiedt op eigen risico.

7. Beëindiging

De beheerder kan de toegang tot de Dienst beëindigen:

• Bij overtreding van deze Voorwaarden

• Bij langdurige inactiviteit

• Indien voortzetting technisch of juridisch niet langer mogelijk is

Gebruikers kunnen hun account op elk moment laten verwijderen door contact op te nemen met de beheerder.

8. Aansprakelijkheid

De Dienst wordt geleverd “zoals deze is”.

De beheerder is niet aansprakelijk voor:

• Dataverlies

• Indirecte schade

• Bedrijfsschade

• Inkomstenderving

Voor zover wettelijk toegestaan.

9. Wijzigingen

Deze Voorwaarden kunnen periodiek worden gewijzigd. Bij significante wijzigingen kan een melding worden gedaan via de Dienst.

Voortgezet gebruik van de Dienst betekent acceptatie van de gewijzigde voorwaarden.

10. Toepasselijk recht

Op deze Voorwaarden is Belgisch recht van toepassing.

Geschillen worden bij voorkeur in onderling overleg opgelost.

Les présentes Conditions d’utilisation (« Conditions ») s’appliquent à l’utilisation du service Nextcloud hébergé sur cloud.davevancauwenberghe.be (le « Service »). En utilisant le Service, vous acceptez ces Conditions.

1. Description du service

Le Service fournit un espace de stockage cloud personnel, le partage de fichiers, la synchronisation et des fonctionnalités connexes via le logiciel Nextcloud.

Le Service est fourni selon le principe du « best effort » (meilleurs efforts) et sans garantie de disponibilité permanente.

2. Accès et comptes

• Vous êtes responsable de toutes les activités effectuées via votre compte.

• Vous devez conserver vos identifiants de connexion de manière confidentielle.

• Toute tentative d’accès non autorisé aux comptes ou données d’autres utilisateurs est strictement interdite.

L’administrateur se réserve le droit de restreindre, suspendre ou supprimer tout compte en cas d’abus ou de violation des présentes Conditions.

3. Utilisation autorisée

Vous acceptez de ne pas utiliser le Service pour :

• des activités illégales ;

• la diffusion de logiciels malveillants, virus ou tout autre code nuisible ;

• l’accès non autorisé à des systèmes ou réseaux ;

• la violation de droits d’auteur ou d’autres droits de propriété intellectuelle ;

• l’hébergement ou la diffusion de contenus illégaux.

4. Données et stockage

• Vous restez propriétaire de vos données.

• L’administrateur n’accède pas au contenu de vos fichiers, sauf lorsque cela est techniquement nécessaire pour l’exploitation et la maintenance du Service.

• Des sauvegardes peuvent être effectuées, sans garantie absolue contre la perte de données.

Il vous incombe de conserver vos propres copies de sauvegarde pour toute donnée importante.

5. Disponibilité et maintenance

Le Service peut être temporairement indisponible en raison de travaux de maintenance, de mises à jour ou de problèmes techniques.

Aucune garantie n’est fournie concernant :

• la disponibilité continue ;

• l’accès ininterrompu ;

• le fonctionnement sans erreur.

6. Sécurité

Des mesures techniques et organisationnelles raisonnables sont mises en œuvre pour protéger les données. Toutefois, une sécurité absolue ne peut être garantie.

L’utilisation du Service se fait à vos propres risques.

7. Résiliation

L’administrateur peut mettre fin à l’accès au Service notamment :

• en cas de violation des présentes Conditions ;

• en cas d’inactivité prolongée ;

• si la poursuite du Service n’est plus possible pour des raisons techniques ou juridiques.

Les utilisateurs peuvent demander la suppression de leur compte à tout moment en contactant l’administrateur.

8. Responsabilité

Le Service est fourni « tel quel ».

L’administrateur ne saurait être tenu responsable de :

• la perte de données ;

• les dommages indirects ;

• les pertes commerciales ;

• les pertes de revenus.

Dans les limites autorisées par la loi applicable.

9. Modifications

Les présentes Conditions peuvent être modifiées périodiquement. En cas de modification importante, une notification pourra être effectuée via le Service.

La poursuite de l’utilisation du Service vaut acceptation des Conditions modifiées.

10. Droit applicable

Les présentes Conditions sont régies par le droit belge.

Tout différend sera, dans la mesure du possible, résolu à l’amiable.
